Defection to APC: Court sacks Dave Umahi, deputy from office

A Federal High Court sitting in Abuja has today, Tuesday March 8, 2022 sacked the Ebonyi State Governor, David Umahi and his deputy from office.

The court presided over by Justice Inyang Ekwo held that the governor and his deputy were elected on then platform of the Peoples Democratic Party and should not constitutionally pass on the votes belonging to the PDP to the All Progressives Congress, APC. According to the court, the. Votes that elected them were for the PDP and not transferable to another party. It further directed that they should henceforth stop parading themselves as Governor andDeputy Governor of the State respectively, forthwith. The judgment of the Court may have relied on the principle espoused in the case of Rotimi Amaechi and then governor Omehia of Rivers State. A superior court in sacking Governor Omehia from office held that the votes putting him in office were for PDP and not for him. Amaechi had gone to court to contest Omehia’s nomination by PDP and won. He never contested the governorship election.

This judgment may put paid to gale of defections by politicians from one party to the other.
